Federal Requirements
Under the Food and Drug Administration (FDA) rules:
- The minimum legal age to purchase tobacco products is 21 years across all states. This includes cigarettes, cigars, e-cigarettes, and all nicotine-containing products.
- Retailers must check valid photo identification for anyone appearing under the age of 27.
- All tobacco and vape products must follow federal packaging and labelling requirements, including health warnings and sealed packaging.
- Any product containing nicotine from any source (not just tobacco) is regulated under FDA’s authority.
- Retailers should periodically review the FDA compliance database to understand enforcement trends and ensure ongoing adherence.

Licensing & Permits
You must hold a valid tobacco retail licence for each store location and display it clearly for public view. Age Verification & ID Checking

Every retail location must post visible age-restriction signage near each register stating that tobacco sales are restricted to customers 21 and older. Certain states may also require hotline or warning posters.
Employee Training & Internal Policy
